The Utility Notification Center of Colorado has an Alternative Dispute Resolution (ADR) program available to all facility owners/operators, excavators, and other interested parties regarding disputes arising from damage to underground facilities, including, but not limited to, any cost or damage incurred by the owner/operator or excavator as a result of any delay in the excavation project while the underground facility is restored, repaired or replaced, exclusive of civil penalties that cannot be resolved through consultation and negotiation.
The program is voluntary, and both parties must agree to participate.
Both parties must first try to come to an agreement through mediation.
If the case still cannot be resolved, both parties will present their documentation to a panel of three arbitrators (professional excavator, facility owner and a representative from UNCC) for resolution. Under Colorado Law, the issue of liability and amount of damages may be decided by the arbitration panel.
However, the ADR program does not change the basis for civil liability for damages.
